Terms of Service

Last Updated: March 2026

The Short Version

Capability Drift provides free educational and informational resources about disability, employment, benefits, and accommodations. We are not lawyers, doctors, or financial advisors. The information on this site is meant to help you navigate complex systems — not replace professional counsel. Use what’s useful. Verify what matters. Don’t sue us for trying to help.

1. What This Site Is (and Isn’t)

Capability Drift (capabilitydrift.com) is an informational resource operated by Jonathan Overturf. The content on this site — including condition pages, benefit guides, accommodation templates, downloadable tools, and blog posts — is provided for general educational and informational purposes.

This site does not provide:

  • Medical advice, diagnosis, or treatment
  • Legal advice or representation
  • Financial or investment advice
  • Tax advice
  • Guaranteed outcomes for disability claims, accommodation requests, or employment situations

If you need medical advice, talk to your doctor. If you need legal advice, talk to a lawyer. We’ll point you toward resources that can help you find both, but we can’t do it for you.

2. Use of Content

All original content on Capability Drift — including text, guides, templates, and downloadable resources — is the intellectual property of Capability Drift / Jonathan Overturf unless otherwise noted.

You may:

  • Read, download, and use our free resources for personal, non-commercial purposes
  • Share links to our content
  • Quote brief excerpts with attribution and a link back to the source page

You may not:

  • Reproduce, redistribute, or republish our content in bulk without written permission
  • Sell or repackage our downloadable resources
  • Claim our content as your own
  • Use our content to train AI models without permission

If you want to use our content in a way not covered above, email [email protected] and ask. We’re reasonable.

3. Accuracy and Updates

We work hard to keep the information on this site accurate and current. Disability law, benefit programs, VA rating criteria, and workplace regulations change over time. We update content as we become aware of changes, but we cannot guarantee that every detail is current at the moment you read it.

Always verify:

  • VA rating codes and criteria with the current VA Schedule for Rating Disabilities
  • SSDI listing numbers and criteria with the current SSA Blue Book
  • State-specific benefit information with your state agency
  • ADA accommodation requirements with current EEOC guidance
  • Any information that will be used in a legal, medical, or financial decision

We include sources and references on our condition pages and guides. Use them.

4. Email Communications

If you subscribe to our email list (powered by MailerLite), you agree to receive periodic emails from Capability Drift containing new resources, content updates, and related information. We will not sell or share your email address with third parties.

You can unsubscribe at any time using the link in every email. Once you unsubscribe, you will not receive further emails from us (though it may take up to 48 hours to fully process).

5. External Links

Our site contains links to external websites — government agencies, nonprofit organizations, medical references, and other third-party resources. We link to these because we believe they’re useful, but we do not control their content, accuracy, or availability.

Linking to an external site does not mean we endorse everything on it. Use your judgment.

6. Comments and User Submissions

If we enable comments on the blog or accept user submissions in any form, you agree that anything you post:

  • Is your own original work (or you have permission to share it)
  • Does not contain personal attacks, hate speech, or harassment
  • Does not contain spam, advertising, or self-promotion unrelated to the topic
  • Does not contain personally identifiable information about other people without their consent

We reserve the right to remove any content that violates these guidelines.

7. Limitation of Liability

To the fullest extent permitted by law, Capability Drift and Jonathan Overturf are not liable for any direct, indirect, incidental, or consequential damages arising from your use of this website or reliance on its content.

This includes, but is not limited to:

  • Outcomes of disability benefit applications or appeals
  • Results of accommodation requests
  • Employment decisions made based on information found here
  • Actions taken based on our downloadable templates or guides

We provide information. You make the decisions. The outcomes are yours.

8. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the site after changes are posted constitutes acceptance of the updated terms.

9. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, United States.
